Media License Policy
Media License & Copyright Policy
Jaybird Aerial Photography, LLC
Ownership
Jaybird Aerial Photography, LLC owns the copyright to all photos, video, aerial imagery, 3D tours, and floor plans we create. Copyright is not transferred when you purchase services. You are purchasing a license to use the media.
License to the Hiring Client
Once payment is received in full, the client who ordered the media (usually the listing agent) receives a non-exclusive, non-transferable license to use it to market and sell the specific property photographed. This includes MLS, listing websites, social media, print materials, and advertising. The agent may also use the media to promote their own services in their portfolio.
Sharing with Sellers
Agents may share media with their sellers for personal use, such as keepsakes or sharing with family. Sellers may not use the media to advertise or sell the property themselves (for example, “For Sale By Owner,” rental, or vacation-rental listings) without a separate license from Jaybird Aerial Photography.
What Is Not Permitted Without Written Permission

Transferring, selling, or giving the media to a third party for their own use.

Use by another agent or brokerage, including if the property is relisted.

Use for a different property or purpose than the one ordered.

Removing watermarks or credits, or altering the media in a way that misrepresents the property.
Relisting, New Agents, and Sellers

Existing media may be licensed to a new party for a transfer fee based on the original package:

Agent relisting the property: 50% of the original package price.

Seller or other party: 100% of the original package price.
Please contact us before using existing media. Updated or additional media is available at regular rates.
Any reimbursement arrangements between agents and their sellers are separate from this policy and are not the responsibility of Jaybird Aerial Photography.
3D Tours and Hosting
3D tours and hosted media links remain active for 12 months or the length of the listing, whichever is shorter. Extended hosting is available on request.
Our Rights
Jaybird Aerial Photography may use the media in our own portfolio, website, and promotional materials.
Unauthorized Use
Use outside the terms of this policy is not authorized and may result in a takedown request and licensing fees.
